The statute of limitations in credit card cases depends on what the agreement says. Parties to an agreement can alter the law and statute of limitations. Most credit card agreements do provide that the law of a certain state applies. The states they choose are all greater than 4 years. Having said that, there are sometimes ways around that in the hands of a good consumer lawyer. Florida is 4 years for an oral agreement and 5 for a written one.
