Auto Misrepresentation
My son purchased a used '03 Mustang from a dealer over a year ago who showed him a Carfax rpt that stated the vehicle was clean and no accidents. He tried to trade it the other day and a different dealer showed him an Auto Check report that showed the car had been in a front end impact that caused frame damage and that the auto had been run through auction 3xs and the frame damage was announced everytime. Needless to say the dealer would not even consider taking the car on a trade. Does my son have any recourse against the dealer who sold him the auto and misrepresented its history. Because of the lies my son is stuck with a car he would like to trade on a newer one but its is like he is paying for a lost cause. when it is paid off he is still stuck with it because of the bad history. Your son can sue the original selling dealer for fraud. If the car cost was under $5,000 you can do this in small claims court. If more than that then you will probably have to hire a lawyer. You should also immediately notify the State Attorney for your county as this is felony fraud in most counties. Good Luck.
