Legal Question in Consumer Law in Florida

Binding contract

On December 25 our house suffered significant damage from a tornado. A general contractor soliciting business came to our door saying that he was a preferred contractor for our homeowner's insurance company. We signed a contract with him on Dec 26 to do the repairs for which we have as yet to receive a written estimate. When we signed the paper we thought that we were signing giving him permission to do the estimate when in fact it was a contract. I know that we should have read it more closely, but we were still in shock from the storm and obviously should have used better judgement. It went past our three day cancellation window before we realized what we had signed. If his estimate comes in higher than the insurance settlement and we cannot afford for him to do the work is there any way to get out of that contract?

Re: Binding contract

It is hard to give good advice without seeing and reading the contract. Since he has not started work yet, you should contact him and tell him you want to get other bids, that you did not realize this was a contract. See what they say.

does it have a price for the work?

Does it have a start date?

Does it say what happens if they don't start on time? If they have not, that may provide a basis for you to cancel the contract.
