Legal Question in Consumer Law in Florida

Boat falling apart

My husband and I live in Fl we were mailed a sales flyer from SC for a JetMax(attaches to a Jet ski) that turns the ski into a boat. We called on the JetMax and the company was coming to FL to do demo rides, we demoed, like the Jetmax and ordered one. The company originally told us that they had a marina in St Pete that could fix any repairs. The JetMax was delivered to us in FL and after having it less than 30 days we noticed major problems, after calling the company every day for several months, they finally came to FL and took it somewhere locally to have fixed, it was delivered back to us at 9:00pm at night so we could not see any repairs done, the repairs are worse now. We have called the company but have had no response, we have also filed a claim with the Better Business Bureau in his county in SC. The company did not respond to the Better Business Bureau so I am trying to find out what to do next, the JetMax came with a one year warranty and it has taken me six months to get this far with the company. I just want my money back and for them to take this piece of crap back. I have photos and documented notes of all conversations with this company. Please help..

Re: Boat falling apart

Generally, a lawsuit based on the breach of a warranty, whether implied or expressed in the terms of the contract itself, may be filed in the county where the breach occurred. Therefore, unless the contract says otherwise, then the action need not be filed in South Carolina. If you need the assistance of counsel, contact me at (305) 769-3000.

Sincerely,

Randall L. Gilbert, Esq.
