Legal Question in Consumer Law in Florida
I went to buy a smartphone at a retail store. At the display of phones, one phone had a "promo sticker" under it that read "Buy This Phone and Get a $100.00 gift card. I told them that I wanted THAT phone WITH the card. They refused to sell it to me. I was told that the "promo" did not start until the next day and that I would have to come back then. Sure enough, on the promo sticker was a date. However, even with my glasses I could not read the effective dates of the promo. Can they do that?
1 Answer from Attorneys
Yes, they can do that. If you really want to do something about it hire an attorney for around $3500 and see what can be done. In addition you may want to report the company to the better business bureau. If it is indeed false advertising you can report that to the secretary of state.
