Legal Question in Consumer Law in Florida

I canceled my lawn mowing service on September 12. We had no contract with the company, just a handshake agreement. He is now demanding payment for the entire month of September even though he came out to mow for one week. Can I just send a payment for half the month?

An oral contract is enforceable. If you agreed to pay on a monthly basis, and he agreed to provide service on a monthly basis, you are obligated to pay for the month. If you can negotiate an agreement that you pay for 2 weeks, and he accepts this, then get his signature on an agreement.

If you cancelled the mowing service due to their breach of contract (not showing up, not cutting the grass or trimming the way that was agreed to, or some other substantial breach) then you may not be obligated to pay for more than you actually received.
