Legal Question in Consumer Law in Florida
change of venue
I am the defendant in a Small Claims Civil suit. I have requested a Motion for Change of Venue due to Improper Venue. If the Motion is granted, will the case be automatically transferred to the proper venue or will the plaintiff have to re-file and pay the filing fees for the correct court venue?

Re: change of venue
the case will likely be transferred if the motion is granted. If the change in venue requires additional filing fees the plaintiff will be required to post those additional fees, but the original filing fees will be applied.
If the case stays in Florida Small Claims the fees will be the same.
