Legal Question in Consumer Law in Florida

Civil Trial Attorney Needed

I am a military member looking for an attorney who will take pro-bono or recover fees from the trial. I dont have any money to cover a retainer, here is my situation maybe you can help.

I applied for a loan to go to school at Clearwater academy in December of 2006, I cancelled the loan request because I wasnt going to attend the school. However Clearwater Aviation collected the loan money, and is giving me the run around and is wasting my time and money by not helping me solve the debt that is said I owe. Which I dont, because I never attended school there. I spoke with the president several times to clear this matter, however he wont give me anything in writing stating that he has paid back my student loan. I have had people from the News contact the school, the bank, yet he still will not pay the money back to the school. The president/owner of this school cashed the check knowing I wasnt going to go to school there. I need to know what type of attorney I need to hire, Its not small claims because the amount is $43,500.00.

I have filed 2 complaints with BBB, 1 complaint with FCC, 1 complaint with Florida State Consumer Division, and also with the bank and the servicer of the loan.

Let me know if you can help.

Re: Civil Trial Attorney Needed

Your right to cancel and not still be obligated for the tuition depends on the paperwork that you signed.

Your obligation to the bank, again, depends on the paperwork that you signed. If it was only a request for a loan and nopt a loan itself, then the bank should not have paid the school and your beef is with the bank, not the school. Take a look at the paperwork. Take a look at what documents govern your case.

If you signed loan paperwork to pay tuition, authorized payment, and there was payment before you cfancelled the loan (if that was possible), then your rights depend on the paperwork with the school.

Do you have all of the paperwork?
