gave deposit for purchase of boat to be held in escrow by seller...boat not ready as agreed...hurricane, also, caused us not to continue purchase as we cannot get to texas.(no fuel closed marinas etc...seller cashed check and did not hold in escrow as agreed....seller had to pay to (he says 6700.00) bring boat up to sale condition as per survey... seller will not return deposit of $10,000.00 says his lawyer said he did not have to because he had to pay for repairs, however, he agreed to these repairs in said purchase agreement
seller aware of work that needed to be repair prior to survey per his staff.
What recourse do we have to obtain deposit?

Re: contract
If the Seller refuses to return your deposit, then your only option is to seek redress through a lawsuit providing you have not breached the Contract in any way.
I stronly suggest you consult a local attorney to review the agreement and advise you of your legal rights. This forum cannot take the place of meeting with competent counsel who has had the opportunity to review all pertinent information and then advise you of your rights and obligations.
