Legal Question in Consumer Law in Florida
Contract valid?
My husband and I recently looked into purchasing a travel railer. We applied to 2 different banks to see which would give the better rate. One of the banks called and left a message stating that there was an identity theft on his credit report and they could not put the loan through wihtout verification from my husband. My husband left them a message stating to call him to discuss this loan. We did not hear anything back from the bank. We did, however, 2 weeks later recieve a letter in the mail stating that the loan had been approved and our first payment was due within 2 weeks! When my husband called the bank, they said that the dealer had authorized them to push the loan through because we had signed a paper with them for the application. So, without any verification, they push it through. We do not want the trailer and have told the other bank that we were approved through that we are not buying the trailer and they have closed it out. Is the other bank allowed to push through a loan without verification from the individual with an identity theft alert on his social, or are we stuck with a trailer we do not want??

You should have your purchase documents reviewed carefully by an attorney. You may have unwittingly applied for credit when signing papers with the dealer.

If you signed a contract to purchase the trailer, read it; you may be stuck. If not, then you should be able to cancel the loan and avoid the purchase.
