if i am 16 and he is 18, is it okay to date if we don't have sex?

Sure. Don't get "cute" about what sex is, though. Tell him to keep it in his pants and do not engage in sexual activity. Though not a legal issue -- it is generally a dumb idea for a 16 year old to be dating an 18 year old and your parents are probably in a good position to explain why that is the case to you. Seek their advice, counsel, and approval for your dating conduct. Better yet, wait till you are 18.
