Legal Question in Consumer Law in Florida

Denied insurance

Three years ago I was denied coverage for inpatient care regarding an eating disorder.I had this disorder for 20 years.I was in outpatient care off and on for that time.My insurace co. told me to drive 4 hours to a facility that treated my condition. After I was admitted for 3 days thay denied coverage.I'm aware of other situations in other states that are suing the same ins. co. for the same claim.I'm deeply in debt for this.I've done all I know. What else can I do and how can I find out about other judgements against this insurance co?

Re: Denied insurance

Your rights are probably governed by a federal law known as ERISA, which governs most insurance claims if the coverage was provided by your employer, as opposed to being privately bought. The ability to make a claim would be governed by your insurance contract. Unfortunately, although Florida law would give you 5 years to pursue a breach of contract (written) claim, almost all ERISA plan contracts require you to have filed certain paperwork long before the three year period in your post.

Check your insurance contract to see how you should dispute a claim denial.
