Equipment Lease/Product Purchase Agreement
Hi: I would like to know if I signed the above type of agreement (6yr term) and have 8 months left of the term, but after reviewing a copy faxed to me, it says I have to give 12 month written notice to to cancel renewal for another 6 years, but do not want to go another 6 month term, due to billing problems, bad customer service, etc. and was not aware of all the fine print. (my mistake) plus the terms show a maxium charge that was marked over but not initialed, what are my options on this? This Corp. has pretty much all the market in my area, so they bully and dictate to you there fees, etc. The payment terms show a maximum amount that I was sure was higher, but I do not have the original, and like I said the amount appears to be written over, but never initialed by either party...They are sending separte Cap bills for the overage (CO2) which are outrageous....can they enforce this agreement? The Sales coordinator who signed the contract with their company is no longer with them. Previously they were waiving the cap charges, but now they are threatning to pick up their equipment, etc. if we don't sign a new lease and pay the last few month cap charges... Please let me know if this agreement is enforceable without initials?

You can pay an attorney to try to get you out of the agreement, but that would leave you stuck without equipment from what you write. Let me know if you want legal help; I do a lot of contract negotiations like this.
