Legal Question in Consumer Law in Florida

I contracted with a custom cabinet maker to build and install kitchen cabinets in my home. I gave this person $7,000 as a down payment which he said was necessary to order the materials and build the cabinets. On the day before he was supposed to come install the cabinets, my wife called him, unsuccessfully, several times and left messages. On the day he was supposed to install the cabinets we called his number and the voicemail said he was going out of business. I confronted him in person and said I wanted my money back. He stated he spent the money to pay suppliers for other cabinets. He apparently has a lawyer, but I would like to know what recourse I have before calling the attorney. Thank you.

Re: fraud

You have amde demand and refuses to pay then you have no other choise but to sue. The questions is, whether he has any money to collect from. Also, was he working as an individual or under a corporation. If there is a written contract, there could be an attorney's fee provision and you may be able to recover.
