Legal Question in Consumer Law in Florida
Gym membership
I signed a contract in July for a gym membership but had to cancel the contract. I wrote a letter and had it hand delivered to the gym before the 3 day cancellaton allowance. I had it signed by an employee who tried to call the manager but couldn't find her. She had no copy machine so I faxed it back to the gym as soon as I got home. The owner refused to cancel my contract because she said the employee that signed the letter wasn't authorized to do so. They are taking the money automatically from my credit card. I want to take her to small claims court. They are put me into collections. It's a small claims dispute but I don't know if I need a lawyer or where to even go to sue the company. Can you please help me? Thank you.
