Legal Question in Consumer Law in Florida

I hired a web design company to build two web sites for me, no written contract, but a verbal agreement made, I have their policy manual. I was overseas and I was accused of being rude and they stated they did not like the tone of my e mails. They refused to continue building the web sites, and now they refuse to reimburse me the funds I paid them, both web sites are incomplete. I have been advised to start afresh completely and I have started working with another company. I am almost $2000 out of pocket, although I never had a written contract but plenty of emails from them that does make it obvious they were building the sites etc, I am considering trying small claims court to get my money back, I have sent several certified letters asking to be reimbursed but received no reply. Please advise me. Thank you very much. John Dorward

It never ceases to amaze me that people will enter into business relationships, exchange thousands of dollars for services, and never put their agreement in writing.

The web designers did provide services, although they did not complete the job. If you hire another web designer, you can get his opinion whether the work can be continued or whether it needs to be fixed or whether it needs to be started from scratch. If the work the previous designer did needs to be fixed or scrapped, it is possible that you can receive some reimbursement for the money you paid them. However, the opinion from a new designer will need to be an expert opinion which a judge will accept in assessing whether you are entitled to your money back. It will not be good enough for the new designer to just prefer to start over and do it himself.

Please, when you hire another web designer, get your agreement in writing.
