Legal Question in Consumer Law in Florida
My husband and I stayed at best western at west palm beach airport on March 26-29. then they charged us 104 dollar dry clean fee on May 21 which we never done. I disputed with CC but they rebilled to my account since the hotel sent our checkin form and original invoice (which I was expecting from CC right now.) What should we do to prove it is not our service? My husband burned his leg at the hotel room and my friend sent him to emergency room. Are we able to sue them?
I felt so frustrated to contacted with hotel for the refund. Even called headquarter but they could not do anything. The hotel even ignored complain from BBB so was rated as F.
Thank you for your answer.

It will cost almost that much to bring a lawsuit in small claims court. You can check the information available on the Palm Beach County court's website. Dispute the charge through your credit card (not the hotel) and ask for a charge-back to your card. When you call the cc, keep your emotions in check and try to speak to them in a formal, businesslike manner. Also, write to the cc at its billing inquiries address within 60 days after the first bill with the wrong charge on it. See information on the Fair Credit Billing Act here: http://tiny.cc/72jug.
Whether your husband can sue for his burn/accident will depend on the facts of the accident and how the hotel caused it. There are no facts here related to this separate issue, so if your husband thinks the hotel is responsible, he should consult with a personal injury attorney. Regards,
