Legal Question in Consumer Law in Florida

My husband had the transmission rebuilt on his pickup on 8/12/09 & was given a warranty of 12 mo/36000 miles. It was only driven 5787 miles since & broke down. The repair shop put off accepting responsibility for a week & then towed it in on 8/2 but didn't start work till after 8/4 only to admit to using parts off of another "rebuilt" transmission & its still has problems. He refused to extend the warranty & practically laughed in his face. What can we do? Elizabeth H

If you have the warranty in writing, it is enforceable. You may be forced to take the mechanic to small claims court in order to collect the amount that it costs you to have the truck fixed elsewhere. Be sure to give the 1st mechanic notice, meaning written notice, sent via registered mail that you expect him to make good on the warranty and repair the truck in a timely manner. If the mechanic still laughs in your face, take your truck elsewhere, get written quotes for the work that is necessary and a detailed list of what the problem is, and how it was fixed, and then see a general practice attorney to file your claim against first mechanic.
