Legal Question in Consumer Law in Florida
I purchased an ipad through a local meet with an individual. Upon receiving it and seeing that it was working i purchased it. however when i went to restore it and put my information into the device i was unable to use it and now the device is rendered useless to me. The seller "does not remember" the original password to activate the device. Do I have a case in getting my money back? the only proof of transaction i have is text messages through a phone.

The problem here is more than your only proof of the transaction being through a text message. You need to know who you are going to file this action against. The name of the person, mailing address, etc. This person is going to need to be personally served with the court papers of your lawsuit. If you have the requisite information, I believe you have a valid case. However, like I already mentioned, we need to know who to sue.
If you do have this person's information, more than just a phone number, and find yourself needing the assistance of counsel, e-mail me at [email protected]
