Legal Question in Consumer Law in Florida
Purchased Lowe's Extended Protection Plan (EPP) with fridge. Lowe's sent out their service contractor, Nationwide Appliance (NW), to repair fridge who in-turn burned my floor. The service contractor requested estimate for flooring repair, which I faxed to them. Estimate was $601.28. The service contractor said they'd cut me a check. Check never came so I sent certified letter to Lowe's Service Advantage Corp. Office for assistance. The service contractor has told us on 5 different occasions that the check was mailed - the check never comes. The service contractor obviously has no intention of paying for the damages. We think Lowe's should pay for the damages as our contract (EPP) is with Lowe's not NW. This issue has been ongoing for 20 weeks now. Do we have a case? Is Lowe's liable?
