Legal Question in Consumer Law in Florida
I purchased a used suv from a buy here pay here dealer. contract is dated 10/7/10 for 9,995. I picked up the suv on 10/18/10. I went to the dealer today to have them see why the check engine light is on and I was told the truck was suppose to be sold at 12,995. They r asking me for the additional 3,000. Are they able to do that after 14 days from the signed contract? Do they have the ability to cancel now or take the truck back? I also have a copy of the posting on thier website where the suv is posted for 10,497.

The dealer may not cancel (or change the terms of) the contract after you have completed your duty to perform under the contract. This means that once you paid the contract price for the vehicle, it is yours. The difference in price does not reflect an absurd or obviously erroneous price. If your contract had mistakenly charged you $12.95 instead of $12,995, the dealer would have a better case, but the price charged was reasonable.
Whether or not the dealer will fix whatever is wrong with the vehicle depends on the warranty that was included in your contract.
