Legal Question in Consumer Law in Florida
We purchased a vehicle from a private owner. The seller assured us there was nothing mechanically wrong with the vehicle. We paid him case and he wrote on the receipt "as is". We drove the car home and parked it in the driveway. The next day we used the car to run some errands and while out the car overheated, this was a Saturday. We put water and anti-freeze in the radiator and drove the car Sunday. Again the car overheated. On Monday we took the vehicle to our mechanic and were told the head gasket was blown. We have tried to fix it without replacing the engine however we have not been successful. The mechanic said our only option is a new engine. Oddly enough the gentleman we bought the car from is a mechanic. Would we have a case if we took the seller to small claims court?

No. The car was sold to you "as is."
