refund entitlement
Am I entitled to a refund if the store clerk damaged a garment in the course of removing the security tags. She then giftwrapped the tshirt so we didn't see the hole in it from her tag removal till we opened the gift. the store refuse to refund even though they caused the hole. We have already spent over $700 in there this holiday season and don't want to accept an exchange, please tell me if I can legally demand a refund

You mean they oferred an exchamge, but you insist on a full refund? I think you are on the losing end of that one. I am surprised the oferred the exchange and did not dispute how the hole was caused. Go exchange the shirt.
