Restocking Fee
I placed an order over 1 year ago on applicances and plumbing for a new home I was going to built. Plan approvals have been denied and I will no longer need to goods, since construction will not take place. I am being charged a restocking fee of 25%. I never received the goods and I had advised the vendor to take to deposit as a good faith that I will purchase once plans are approved. Now they want to charge me the fee. They DO NOT even have the goods in stock or ordered from their vendor. Can they charge me that restocking fee even if they never paid for the goods?

I would not think that they can charge a restocking fee for items that were never unstocked.
