Legal Question in Consumer Law in Florida

Ripped off

My 16 yr old son paid a $500 deposit towards the purchase of new rims for his truck back in Jan 07. The manufacturer cannot meet the demand for the rims and so the seller agreed to refund the money. It has been a month of excuses as to why he doesn't have the money. He apparently only deals in cash, doesn't have company checks. He is always waiting for a check to clear/ I'll pay you tomorrow/ isn't onsight to find etc. etc. I'm not sure what to do.

NOTE: This communication is not intended as and should not be interpreted as legal advice. Rather, it is intended solely as a general discussion of legal principles. You should not rely on or take action based on this communication without first presenting ALL relevant details to a competent attorney in your jurisdiction and then receiving the attorney's individualized advice for you. By reading the "Response" to your question or comment, you agree that the opinion expressed is not intended to, nor does it, create any attorney-client relationship, nor does it constitute legal advice to any person reviewing such information, nor will it be considered an attorney-client privileged communication. If you do not agree, then stop right here, and do not read any further.

File a complaint. Try the police first. If they will not accept a complaint, then file with the Better Business Bureau (to which he probably does not belong) and any other entity that is in your community. Check with the consumer affairs office of your city/county government. They may have a vehicle to help resolve disputes such as this.

Failing all else, then file a complaint with the local county small claims court.
