Legal Question in Consumer Law in Florida
Sale of Puppy- Died
I sold a Yorkie - with a one week old health cert and shots.I am not a breeder. I sold one puppy last year and one this year. The puppy was 9 weeks old.. never sick -not once. He went to new home friday morning, on Monday he was doing just fine. I have an email to say so. The next friday morning he is so sick he can't stand. He went to vet, they can not determine what the cause was. He died Sunday. The puppy had hardly eaten since Thursday(threw up thursday also, she did not call me) and not at all Friday Morning- 2 hours after he did not eat and had been throwing up and diharhea, they called me and took him to vet. I told them yorkies must eat & they are prone to hypoglycemia if they do not get enough nourishment & they must not eat anything but puppy food I sent home & to call me if they had any questions or for anything. They now want a full refund. They refused an autopsy, when I found out I requested one, but it was too late. She is now saying she is going to sue me. This dog did not even get sick when he was weaned, nor with his shots and was great until Thursday. They bought this dog for their 8 year old grandaughter. He was playing with an english bulldog. What does the law allow if undtermined cause of death?

You are not responsible for an unknown illness unless you caused it. Just because the dog died does not make you liable. If they sue you they must show that you were somehow responsible. If you get sued I suggest you contact my office immediately. My office is in Orlandol.
