help getting out of a sales contract

On 12/28/06 I bought a new travel trailer with a verbal agrement as long my truck was able to pull it. For the first mile my truck was fine, however for the next five miles my truck was under an extrem strain. How can I get out of this contract? Seller saya I can't.

That's a toughy . . . . did you check with the car manufacturer to see whether the car was capable of pulling the trailer? Is anything in writing? I assume you paid and now have the title. That will make proving or disproving the substance of any contract very difficult. Without anything in writing, you are probably stuck. If there were noninterested witnesses that can testify that the contract was contingent upon the car's ability to safely pull the trailer AND the vehicle manufacturer indicates that the car is not capable of pulling the trailer, then you can get out of the contract because the contingency was not met.
