Yes. You can sell a car without a spare. If they promised you a spare, then you can sue them for that -- but it really isn't worth the expense or mess of a law suit to do so.

Yes. There is no law that requires a dealer to supply a spare tire with a used car. In fact, new cars come with "donuts" instead of a normal tire in order to save money for car manufacturers. Frankly, you have an obligation to look at the condition of the car and all of its components before you purchase it. Tires are the some of the most readily observable parts whose condition can be told by a layperson.
