I found a large bone in a can of tuna and nearly choked on it. Could there be a legitimate lawsuit or not? If so, why. If not, why not?

No.
Nearly getting hurt does not qualify as an injury.
If you ran a red light and almost hit someone, the person that you almost hit could not sue you for nearly getting killed.
