Legal Question in Consumer Law in Florida

Wages garnished for repossession

I bought a car in 1996 that got repossessed in 1998 in Florida. The amount I was originally served for in 2000 is about $8,500. Since then, I have paid about $7,000 towards this amount. Then, in 2004 I became unemployed and stopped making payments. I am now employed and have been paying back all my debts, but before I could set up payment arrangement, they garnished 25% of my wages. The issue is that my wages are being garnished for the whole amount again in 2009. The lawyers claim that the interest brought the sum I owe back to the original amount of $8,500...is this legal? Does the $7,000 I paid towards the car that was repossessed over ten years ago not count towards the total balance anymore? Please advice. Thank you!!!!

Re: Wages garnished for repossession

It does count, but you will need to find out how they calculate the debt. You would owe interest in the original debt, but the amount owed would change as and when you made payments. There are online calulators that can help, as well, to calculate the payments and interest.
