Legal Question in Consumer Law in Florida
Walmart Automotive
I took my wife's car in for an oil change. Since the tech was going to lunch he moved the car from the bay it was in to another bay. But he forgot to pull the oil cap on before moving the car to the other bay. The other tech spray soome soft of cleaner to remove the spilled oil from the engine and then changed the oil itself. The car smoked on the way home, which I thought it would, but now there appears to be an oil leak somewhere since oil has leaked and continues to leak after driving the car onto my driveway.

Re: Walmart Automotive
And I guess Walmart is claiming that the car had a leak before you brought it in?
Well, unless you can prove that the car wasn't leaking before, you've got a tough case against them. Actually, I'm not sure how what you've described would cause a leak. I can see how oil would splatter all over the engine, but I'm not sure how the engine would be damaged, so long as oil was still in the car when they moved it.
Take the car to a good mechanic for a diagnosis, then speak to a lawyer about what your case against Walmart would be.
