Legal Question in Consumer Law in Florida

Warranty settlement

I purcahsed a warrranty on my furniture. The company could not repair it and sent me a settlement letter. I notarized and returned it per their instructions. It has now been more than 6 months and they say that they will pay but never seem to follow through. What can I do. The amount of the settlement is roughly $300. I have a complete audit trail of many communications with the company including copies of the settlement. What can I do?

Thanks,

Vince

Re: Warranty settlement

NOTE: This communication is not intended as and should not be interpreted as legal advice. Rather, it is intended solely as a general discussion of legal principles. You should not rely on or take action based on this communication without first presenting ALL relevant details to a competent attorney in your jurisdiction and then receiving the attorney's individualized advice for you. By reading the "Response" to your question or comment, you agree that the opinion expressed is not intended to, nor does it, create any attorney-client relationship, nor does it constitute legal advice to any person reviewing such information, nor will it be considered an attorney-client privileged communication. If you do not agree, then stop right here, and do not read any further.

You have several options. You can probably contact the office of the local consumer affairs official in the county in which the company is located and file a complaint and they should investigate. This could be time consuming and is not guaranteed to bring worthwhile results.

Second, you can file a complaint with the local Better Business Bureau (BBB). If the company is concerned about their image with the BBB, they may take steps to rectify this problem when confronted with a complaint.

Last, your strongest option is to file a small claims suit against the company in the jurisdiction in which the company is located. Unfortunately, this can be costly - even if you handle it by yourself without hiring an attorney.
