wedding photographer - breach of contract

My daughter hired and paid a photographer to take photos at her wedding. The photographer failed to show up and after repeated phone calls has finally responded by claiming she legally has thirty days to refund the payment. This photographer has only a cell phone # and email contact, no business address. I feel the longer my daughter waits to persue legal action, the more likely she will never see her money. Also, since this was her wedding, my daughter should sue for damages.

Yes, your daughter should not wait. There is no law that gives the photographer 30 days to return money when they breached a contract. File suit immediately. If the photographer eventually pays, then court costs will be added to the obligation.

Read the contract. If she only mus refund the payments, then that is all that she gets. Read the contract.
