Legal Question in Consumer Law in Florida

About two years ago, my father became very ill and was unable to continue working. Because of this, my family fell behind on our mortgage payments. Someone referred us to a person that worked with lawyers to help with mortgage modifications. The company was SaveMTG and I believe they were supposed to be working with United Legal Services. We went through the whole process and provided documets needed, but it took us about 8 months to do so because of my dad's illness. The day after he passed away, SaveMTG's rep told us that we needed to pay $1,075 up front, and then the same amount again after the job was done. My mother did so. I believe under the stress of the situation. One day after my fathers death. A month later the company tries to take out the second payment, and the bank gives it to them! There was no authorization anywhere for the bank to release that money. After some complaints, the company or bank, finally gave us back the second payment. A month later, on Friday May 8th, SaveMTG closed its doors letting go of all of there employees, without finishing their services and while keeping everyone's money. Savemtg demanded the fee upfront before working on there case. The rep working with us said that we could not get our money back because their Company bank accounts had been emptied and the ones with any money in them had been frozen. I just want to know if we have any way of getting at least our payment back? Can we take any legal action against the rep or anyone at all? Or at least threaten with legal action in hopes of coming to an agreement?
