If you have not made any payments on the debt in the last five years, then it is too late for the account holder to file a collection lawsuit against you. The debt does not disappear, meaning that you could still pay it voluntarily and it might be reported against your credit, but it is too late for the account holder to really do anything to actually collect on the debt. However, if you have made any payment within the last five years, then the account holder could still sue you.

It would appear that every collection holder in town is scrounging to locate all accounts with any amounts due. Therein lies the problem. After five years they can not sue you for the account. I would contact Mr. Marino's website and see if you have a case against them for harrassment.
