Legal Question in Credit and Debt Law in Florida

I have a 3rd party bad check. the husband whose name is on the acct. said his wife stole the checks and forged his name. She said she had his permission. the wife was the one who gave me the check. I did not see her sign it just fill it out. do i take her to small claims court or both of them and let the judge decide who is telling the truth. It is for $217.49. The state attorney wont prosecute cause it is a 3rd party check.

Take her to small claims - she is the one who owes you money.
