Legal Question in Credit and Debt Law in Florida
I am a 65 year old now living on social security and family help after being unemployed since August, 2006. Being out of work for so long, I have been unable to pay my credit card debt since approx. early 2009. I own nothing except my furniture and 2003 car (which I just finished paying off after 9 years of lease/finance), my income does not adequately cover my expenses and I have been fortunate enough to secure a part time position (beginning October),after searching for 5 years, to supplement my income. Last evening I was served a summons from a debt collector for $31,508.28 (just part of my outstanding debt) plus court costs and have 20 days to file a written response. What should I do....I obviously can not afford an attorney.........should I just ignore this summons since I have no defense except inadequate resources to pay these debts or attempt to offer some response on my own???? Your assistance is greatly appreciated. Thank you.

Never ignore a summons. Answer the complaint to the best of your ability. Your home and your car are safe from creditors . However, if you obtain a job and place those funds into a checking and/or savings account - they can attach them. They can not attach your social security funds.
When they set the hearing, be sure to attend. You can tell the judge your situation - as you are by all means judgment proof at this point.
