Legal Question in Credit and Debt Law in Florida

4 years ago my ex-husband took out an online payday loan, they are now coming after me for the loan payoff and are telling me that if I do not pay I can go to prison for 5 years. Are they really able to legally do anything to me?

You cannot go to prison for unpaid debt, and unless you are on the promissory note you are not liable for your ex-husband's debt. They are in violation of the Fair Debt Collection Practice Act and should be reported to the Florida Department of Consumer Affairs immediately. The phone number is 1-800-435-7352.
