Appendix b florida smallclaims rules 7.090 b

a creditor is taking me to court and the summons to appear was delivered to me on 8/15/05 and the pre trial hearing is set for 10/26/05 and in a book i found under apppendix b florida small claims rules 7.090 (b)pre trial hearing should be no more than 35 days from the date of filing and mine is over 70 days including weekends and still over not including them is this enough to have it dropped or dismissed this info would realy help me and if you know where i can find this information i would greatly appreciate it thank you
