Legal Question in Credit and Debt Law in Florida
I applied to one of the apartment communities 7 months ago to rent an onebedroom apartment. They charged me 150$ non-refundable application fee and denied my application. They gave me two reasons: non-satisfactory credit score and low income to rent ratio. My credit score was at 750is. My income to rent ratio was 5:1 and they required just 2.5:1. I requested explanations and evidences why I do not meet their requirements. Those evidences were not provided, so I called my credit card company and disputed the dept. My credit card company refunded 150$. In two months I received a call from this apartments community stating I have unpaid balance of 150$. I asked them to provide me with evidences why I did not meet their requirements. Those evidences have not been provided. Two days ago I financed a new car and when car dealer checker my credit score I found out that I have collection on my report from this apartment community. I contacted them again and requested to remove inaccurate mark from my credit report. They emailed me back stating that I owe them 150$,that application fees are not refundable and that they can't provide me with a copy of my credit report or explain why I did not meet their requirements. They told me that they check candidate eligibility through third party and do not receive the actual report. I send them debt validation letter and requested all evidences in writing. I want to sue those guys for:
Violation of the Fair Credit Reporting Act
Economical damage and lost of wages
Attorney's and filling fees
Defamation of Character
