Legal Question in Credit and Debt Law in Florida

My aunt is in a nursing home in Florida, the only income she has is social security which is going toward her care. She has some credit card debt and we have contacted them and told them the situation and all but one has stopped sending bills. My dad is her POA and is not sure what to do. Does he have to pay it or do we ignore the bill? thanks Laurie

If your aunt has no income or assets with which to pay the debt, you and your father should ignore the bills and collection efforts, after notifying the creditor or collection agent. Some aggressive bill collectors will not cease unreasonable demands and will continue to harass those who have no ability to pay. Her social security income, homestead, and certain other

property are exempt from such tactics.

If the creditors continue to pursue collection to the point of harassment, see legal counsel from a consumer lawyer in your area. See also www.ConsumerLawyerHelp.com for your consumer needs.
