Legal Question in Credit and Debt Law in Florida
Bad check to car dealership
I wrote a check to a car dealership as part of the down payment ($500). This was on a weekend. We drove away and got a call the following week that they switched finance companies on us and we needed to sign new papers. We came in and found that the new bank wanted $1000 down, so that meant another $500 check. We explained that we didn't have it and they said that if we could come up with it soon than they would hold it. We initially said to just keep the car and we would try again at another date. Needless to say they were very coercive.
This happened in Oct/Nov of last year. About a week ago I was served papers that I was being sued for $2000 +. I called the finance person at the dealership and asked if I could arrange something and she informed me that it was out of her hands. I called her lawyer and asked if we could arrange something. He was not helpful or receptive to my call and said to just be in court on the date listed.
What can expect on the court date? Will I really have to pay that much ($2000 + dollars)? Will they accept payments?
I'm military and overlooked the first notice because my son was hospitolized at the time (6 days). My fault. I have no record. Court date: 3AUG.

Suggest you retain an attorney to review the matter properly. If you legally owe the $ you should be able to work out a paymeny schedule.

I urge you to retain competent counsel, in your locale or that of the court, in order for you interests to be protected. You may have good defenses.
Without actually reading the complaint, I cannot provide you with competent advice.
