Legal Question in Credit and Debt Law in Florida

bank accounts, ss and retirement payments

Can credit companies get at my bank accounts, ss or retirements if I do not pay the credit cards. My bank accounts are in trust with my son. Can they go after my grown children now or after my death for payment if not paid.

Re: bank accounts, ss and retirement payments

Your question does not have a simple Yes or No answer. You stated that your accounts are in trust with your son. To get to your checking account, for example, it has to be in your name. To go after your grown children, they can be liable, if they signed on the card. If you are experiencing financial difficulties, then I would suggest you contact my office. If you are just trying to protect your "nest egg", then I suggest you contact a Probate Attorney on this list serve. Either way, enjoy your Sunday.
