Legal Question in Credit and Debt Law in Florida
Bi-polar and debt liability?
My wife had credit cards open previous to her bi-polar diagnosis, but shortly before she was officially diagnosed she went on a spree, which is a sign/symptom of the disease. What is our standing with getting any debt's waived? What options may we have? We have 2 trips to the emergency room, 2 ambulance trips, a 3 and a half day stay at a Crisis Stabilization unit, as well as numerous Dr. visits. Thank you for any help.

You have little chance of getting any debt waived. The charges were made and signed for. Your wife's condition will not legally excuse the obligation to pay regardless of how many trips to a doctor or hospital there may have been. Frankly, the creditors would respond to any arguments that you might raise that knowing your wife's condition you were irresponsible in providing her with credit cards. I would suggest that you try to work out a payment schedule if you cannot afford to pay the debt all at once.
