Legal Question in Credit and Debt Law in Florida

capital one debt collection has increased and wont take my payment says thats not enough owed $1300.00 now its up to 3,800. how is that possible. I was willing to make payments of 30-40$$ per month. THey tell me thats not acceptable. Meanwhile it has been almost 2years of like 5 different credit dept agencys and all say that amount is not gonna work. TOday i recieved a court hearing now all of a suddend the balance is $1900.00. I dont get it when it was stopped and closed the account in order to make payments. My court mediation hearing is next month. Just would like some advice please, currently not working.

YOu should dispute the entire amount over the actual amount that was due , present to the court your evidence of trying to mitigate your damages. If they ask for mediation - go for it and over 1/2 of what you owe to settle the case.

They will usually take off all the interest, but do not expect them to tell you that. Then negotiate from there, but never agree to something you cannot live up to.
