Legal Question in Credit and Debt Law in Florida

Can we keep our car?

My 30 yr. old daughter filed bancruptcy a while back. She has also lost her job. She has just had her car repossessed which has a balance on it. If I buy her another car and pay cash for it is the new car safe from being taken by creditors? Should it be in my name or hers? Or both?

Re: Can we keep our car?

Unless all of her debts were discharged I wouldn't have anything in her name.

Anything in her name, unless exempt, is reaqchable by her creditors. The creditors can reach her interest in the non-exempt property.
