Legal Question in Credit and Debt Law in Florida

Caught off guard

I was contacted by a collection agency for a credit card bill that is about 4 years old. They tracted me down by somehow getting my parents phone number, they have my ex-wife's address that they said they mailed information to. I talked to here she said she has received nothing from anybody for me. To get to the point they want me to pay a $4000 bill, but they will provide no information unless I go to court for disclosure. I filed a bankruptcy in 2001 and this card is from 2002. I know the card is not mine what do I do?I also have had no contact with these people until the call at my parents home

As I do not have all the facts of your scenario, this is not a formal legal opinion. Also, there are several issues here & I do not have time to

cover them all.

As an overview, If you filed BR, was this alleged debt from one of those cards? If so, they would not be able to prevail in a lawsuit. If you are sure you have nothing to do with the debt for this card, tell them. If they desire to take you to court, THEY HAVE TO PROVE it was you. A lot of the time with older credit card debts, one company purchased the debt from another comp. and they will not evid. at trial to prove the debtor is responsible.
