Legal Question in Credit and Debt Law in Florida

Check - stop payment

I recently had body work done on my vehicle but the body shop did terrible work. I went to the shop 4 different times and each time showed them areas that were not done correctly. They assured me each time that they would rectify the problem. I finally went to collect my vehicle but after 5 weeks I'd had enough. I took the vehicle, paid with a check and then stopped payment on the check. I'm now being threatened with arrest. Can I be arrested for something which I think is a civil matter?

Yes. Florida Statute 713.58 makes what you did a misdemeanor with a possible fine of not more than $500 and jail time of no more than 3 months. You might be able to get out of it if you post with the Court as a bond the amount you owed the body shop and then file a lawsuit claming that they did poor work. I don't know where in Florida you are, but you can call me and if you near me I can help. Otherwise, find an attorney near you to assist with this issue.
