i was served a summons its not mine but it has the same name as me on it do i answer it

Yes. You should also call the plaintiff attorney to let them know the wrong person was served.

Yes, but you can deny all the allegations in your written answer because it isn't you. If you don't answer it, a judgment will probably get entered against you.
