Collection of Accident Settlement

A year ago I was injured quite badly in an auto accident and have not been able to work since. During this past year, the US Dept. of Education has defaulted me on a large student loan($29,000). I am now about to settle my accident claim with the person that hit me's insurance company. I intend to use the money to finish my education as I am unable to continue my previous career. Can the USDE take my settlement? Is there any way they can attach a new checking account I plan to open? Thank you for any help you can give.

They first have to have obtained a judgment against you.
